"The DOJ had argued in court that the full memo, portions of which have already been released, should be withheld because it fell under exceptions to the public records law for attorney-client privilege and deliberative government decision making."
How can there be attorney-client privilege between the DOJ and the President? The AG is not the president's lawyer.
>Jackson, who was appointed to the federal district court in Washington, D.C., by former President Obama, wrote in a scathing 41-page decision that "not only was the Attorney General being disingenuous then, but DOJ has been disingenuous to this Court with respect to the existence of a decision-making process that should be shielded by the deliberative process privilege."
41 pages of burn say there cannot
>But in Jackson's decision on Monday, the judge said it appeared that it was a foregone conclusion among DOJ leadership that there would be no prosecution against Trump.
>"Moreover, the redacted portions of Section I reveal that both the authors and the recipient of the memorandum had a shared understanding concerning whether prosecuting the President was a matter to be considered at all," she wrote. "In other words, the review of the document reveals that the Attorney General was not then engaged in making a decision about whether the President should be charged with obstruction of justice; the fact that he would not be prosecuted was a given."
When Barr said he'd determined that the report didn't support charges he was acting as Trump's personal legal team and lying to the entire country. It was obvious then and it's obvious now.
Does this put Barr in the legal hot seat at all for potential obstruction charges on his own?
>"The agency’s redactions and incomplete explanations obfuscate the true purpose of the memorandum, and the excised portions belie the notion that it fell to the Attorney General to make a prosecution decision or that any such decision was on the table at any time," she added.
Sometimes I feel stupid reading this kind of jargon. I could understand the first part if I read it slowly and kinda assume what certain words definitions are. Anyone care to tell me what this statement means? Me guessing is that they basically obstructed or hid what the memo was? And removed portions that would've made it clear that the AG should've done something about it? Or the AG did the obfuscating? I hate when I can't comprehend
'Disingenuous' is being polite. I'd call him a lying sack of shit and corrupt political hack.
I’d say he’s a traitor.
I too feel that Barr was being disingenuous. Barr should have not been allowed to involve himself with the case at all in my opinion because he had clearly picked the side of Trump. So any information that he shared was in Trumps best interest, not the countries.
>The DOJ had argued in court that the full memo, portions of which have already been released, should be withheld because it fell under exceptions to the public records law for attorney-client privilege and deliberative government decisionmaking.
If they are trying to argue that Barr was acting as Trump's attorney, then I believe it would be illegal for Barr to do anything that would not be in Trump's best interest as the client that he represents.
>**A federal judge has ordered the Department of Justice (DOJ) to release a March 2019 legal memo that advised then-Attorney General William Barr that the special counsel's investigation did not support prosecuting former President Trump, issuing a scathing decision that accused Barr and department lawyers of deceiving the public.**
>**District Judge Amy Berman Jackson on Monday ordered the DOJ to release the legal memo in two weeks in response to a Freedom of Information Act lawsuit filed by the liberal watchdog group Citizens for Ethics and Responsibility in Washington.**
>**The DOJ had argued in court that the full memo, portions of which have already been released, should be withheld because it fell under exceptions to the public records law for attorney-client privilege and deliberative government decisionmaking.**
Jackson again? She was the judge in the Manafort case and possibly the Stone one too? I hope she has heavy duty security.
Barr belongs in prison
You don't have to be a rocket scientist to read the Muller report and conclude Barr lied his ass off to protect Trump. The AG shouldn't be the president's defense attorney. Justice please.
"Disingenuous" is a term lawyers and judges use in lieu of "a fucking liar."
Just wait until the closet is fully opened and the skeletons buried way in the back are uncovered. Bill Barr was just as corrupt as Trump. He just sounded "smarter".
Barr should be Disbarred, in disgrace
Barr has 100% provenly been disingenuous.
During congressional questioning Barr was asked how Mueller felt about Barr's report on Mueller's report. The report which very obviously changed Mueller's original intent on the report.
Barr stated that he did not know how Mueller felt. This was a complete and absolute lie because Mueller had already sent him a private note stating his frustration at Barr's behavior.
Let's blast this goddamned piñata open once and for all. That fucker's guilty as shit and this corrupt piece of garbage covered it up under a mountain of bullshit, cheered on by the entire Republican Party. Continued avoidance of prosecuting these fuckers is only going to eat away at this country even more.
We know the GQP can't handle truth or facts, so fuck 'em. We'll do it ourselves then.
In Nelson Muntz voice “HA-ha!”
I think I like Judge Amy Berman Jackson.
Ain't she the one Roger stone put crosshairs on?
The word is 'liar'. He obstructed justice, abetted treason. Bar is a criminal, treasonous liar
There could be a weekly press conference devoted to exposing and explaining the corruption of the last administration, and I don't think they'd run out of material for Biden's entire term. In fact, I think that's exactly what they should do, and let Republicans wail about it all they want.
I mean, that's kind of what the last four years *were*. It was fucking awful.
[Before he was chosen to be attorney general, Bill Barr wrote a memo saying that a president cannot be charged with obstruction of justice. This was, in effect, his job application.](https://www.lawfareblog.com/bill-barrs-very-strange-memo-obstruction-justice)
We all know how things played out. Trump did make Barr the attorney general and Barr, in return, cleared Trump of all obstruction investigations **as he promised to do.**
Amy Berman Jackson is, and has been, the type of judge America needs. Honest.
**Judge orders release of Trump obstruction memo, accuses Barr of being** **~~'disingenuous'~~** **a straight-up fucking liar**
I swear, if Trump is never prosecuted this country is absolutely done. The crazy is staying at dangerous levels with no sign of abating. People believe January 6th was a Antifa undercover event. That all the people being prosecuted are secret Antifa operatives playing a REALLY LONG CON and willing to go to jail because Soros will eventually bail them out or pay them reparations for their service. I mean, people actually believe this sputum of bullshit. The GQP has already shifted to being against the "Woke Mob", which begs a couple of questions. First, what does the GQP stand FOR besides racism, misogyny, and tax cuts for the wealthy. Second, they still have the Karl Rove playbook memorized: take your enemy's greatest strength and frame it as a weakness. The GQP is THE MOB, the actual physical mob of traitors that stormed the capital on January 6, 2021 chanting "hang Mike Pence" , and now they are using that label to define progressives.
> "The agency’s redactions and incomplete explanations obfuscate the true purpose of the memorandum, and the excised portions belie the notion that it fell to the Attorney General to make a prosecution decision or that any such decision was on the table at any time," she added.
So, they twisted what they released to the public in order to make people believe a story that is different from the truth. The judge is saying that the unredacted version tells an entirely different story than the narrative put forth by the Trump Administration.
Not only did they put the fix in to disregard the findings in the Mueller Report Section 1 regardless of what was concluded, they weren’t going to charge Trump of anything, even with the at least 10 instances of obstruction from Section 2.
For those diehard trump apologists, the DoJ is supposed to work independently of the executive branch, especially when investigating said branch. This is basically saying they had no intention of even entertaining the thought of checks and balances against the president, making that position above the law.
Therefore, any grievances you have with Biden can go ahead and be kept to yourselves, because apparently it’s okay for you all to have the president above the law, unless you want to openly admit you’re hypocrites in yet another aspect of politics.
If people like T****, Rudy, Stone et al do not get prison sentences, it will be bombproof confirmation that the USA is nothing but the richest 3rd world type of banarepublic kinda country. Where rich people can get away with anything!
edit 3min later, and by prison I mean sentences much much longer than 1 year! not jail!
'Disingenuous' makes it sound so so so light.
“You disingenuous dense motherfucker....”
Disingenuous? He polluted the Justice Department with partisan fabrications per the wishes of his lying demagogue boss. It would be ironic and apt for Barr to be indicted for obstructing justice.
These fuckers’; Barr, Trump, McConnell, and the republicans, So bummed about being a dying breed that they just want everyone to suffer. They are miserable, pathetic people, who scorn the country they benefitted from. I cannot wait for their imminent extinction. These are the last desperate dinosaurs facing oblivion.
One-hundred years from now they will only be recalled as shameful relics of a dark, broken age, who’s’ names are synonymous with corruption and deceit.
Submissions for this story keep disappearing. What's the deal?
Barr lied, multiple times.
They may as well tell him that "they're not mad, they're just DISAPPOINTED" as well. DO. SOMETHING.
Trump truly was a criminal president from top to bottom. His entire administration was practicing criminality and lawlessness. Throw them all in prison where they belong and close this dark chapter in American history.
Robert Mueller failed our nation in the time of needed. He allowed his work to be hijacked and exploited by the very people he was investigating.
Mueller’s report explicitly laid out the evidence and a conclusion that Trump and Co’s actions were criminal. The only mistake he made was following the quasi-law that Presidents can’t be indicted and referring prosecution to Congress.
How bout crooked?
When government is run by bad faith actors it not only fails, it opens the door wide for overall systemic collapse.
To the surprise of: absolutely no one.
Just a reminder that Robert Mueller is a piece of shit. He clearly picked party over country. Never interviewed ANY trump family member, offered and gave immunity to Allan weisselberg and allowed trump and manaforts attorneys to cooperate AFTER manafort had a fucking plea deal! Fuck! Smaller, still shitty thing, Mueller went in front of fucking Congress and said nothing and was applauded for his patriotism. I’m so sick of this shit.
Disingenuous is an understatement.
Barr did his best to keep Trump president and everything he did shows that. He made sure nothing came out that would make the impeachment trials actually trials and not jokes and once he got tired of it, he quit. Just another bag of garbage on the heap right low.
Lil Kim got jail time for lying to the court. Why isn’t this liar in jail? Why aren’t any of these liars in jail?
If William Barr ends up going to prison for this I will laugh and laugh and laugh. Because it will mean he wasted his life to cover the ass of Donald Trump.
